1) WEBSITE TERMS AND CONDITIONS
The term “Ginger & May”, or “us” or “we” refers to the owner of the website www.gingerandmay.co.uk. We reserve the right to revise the terms and conditions at any time.
In using this website you must provide true, accurate and current details. You must warrant that the credit card, debit card or payment account that you use for purchasing of goods from this website, and any e-mail, billing or delivery addresses that you provide, are your own or, if not your own, that you use them with the explicit permission of the owner.
2) TERMS & CONDITIONS OF SALE
Prices are displayed in British pounds sterling (GBP) and include any applicable UK taxes. We reserve the right to alter prices at any time, except after we have accepted your order.
Whilst we endeavour to ensure that all prices displayed are accurate, occasionally a mistake may occur and an item may be incorrectly priced. If a pricing error is discovered after receiving your order we will contact you and give you the option of proceeding with your order at the correct price or cancelling your order. If we do not receive your instruction we will cancel the order and inform you of this by email. We are under no obligation to supply goods at the incorrect price unless we have already accepted your order by confirming it's dispatch.
The store can be browsed by making use of the categories and sub-categories displayed on the navigation bars or by using the search function. Items can be added to your “basket” by clicking the “add to basket” buttons. Once you have made your selection go to “shopping basket” at the top of the screen and click "checkout". You will be guided through the checkout and payment process. During checkout you will be asked for details that are required to process and send your order. You can return to your "shopping basket" at any time to amend or delete items from your order, up to the point where you click “Confirm Order”.
If you have a Ginger & May promotional/discount code enter it on the "shopping basket" page by clicking the "apply discount" button and typing in the code. Promotional/discount codes must be applied before confirming your order as the promotional offer or discount cannot be applied later or retrospectively.
Orders are subject to acceptance by Ginger & May and subject to availability. Your placing of an order constitutes an offer from you to buy the goods, but does not constitute acceptance by Ginger & May to supply them. For the purpose of a contractual agreement between you and Ginger & May, an order is deemed to be accepted only when the goods are dispatched. In the unlikely event we are unable to accept your order we will inform you in writing (by email) and refuse/refund your payment.
We make use of PayPal’s secure on-line payment system, which allows you to pay with a credit card, debit card or, if you have one, with a PayPal account. We are unable to accept other payment methods such as cash, cheques, postal orders or payment with a card by telephone.
Funds are usually not transferred to Ginger & May until we accept the incoming payment and this is usually done when items are ready for dispatch. We will not dispatch goods before receiving payment.
If your card issuer refuses to authorise payment we will not be liable for any delay or non-delivery of items ordered.
The fulfilment of orders is subject to availability. Every effort is made to ensure that the availability of an item is correctly advertised on the website, however if we are unable to supply an item you will be notified by email or telephone and given the option of waiting for the item to be re-stocked if this would be within a reasonable time-frame, exchanging the item for an alternative, or cancelling the order.
Information and product descriptions are as accurate as possible. However, there are limitations to the true reproduction of colours in photographs and it is possible that specifications may change from time to time and be overlooked on the website. Dimensions given on the website are usually provided by the manufacturer and should be considered approximate only. In the event that you are unhappy with the item once received we will be happy to exchange or refund in accordance with our Returns Policy.
We aim to dispatch goods held in stock within a maximum of 3 working days, but in most cases will dispatch on the same day or next. Some items are dispatched directly from the manufacturer, supplier or distributor and in these cases a dispatch time guide will be given with the product information but cannot be guaranteed. You will be notified by email when your goods have been dispatched.
If dispatch is likely to be delayed for any foreseen reason (e.g. during a holiday period) information will be provided on the Homepage of the website. If an order is delayed for an unforeseen reason you will be notified by email or telephone as soon as possible and given an option to cancel your order should you prefer not to wait. We cannot be held responsible, and will not be liable for, any inconvenience or loss incurred as a result of delayed dispatch or delivery.
We currently deliver only within the United Kingdom.
Delivery charges and method depend on the weight and size of the parcel. Charges for our standard delivery start at £1.95 and are never more than £3.95. Delivery is usually by Royal Mail First Class or, for larger and/or heavier items, by Royal Mail Standard Parcels, although we may use alternative methods. See our Delivery page for a full guide on our charges and estimated delivery times. On checkout you may be given additional options for delivery. From time to time promotional delivery charges may be offered or applied.
If you are not in
If you not available to receive the delivery it will normally either be left somewhere reasonably safe (e.g. with a neighbour), redelivered the following day, or returned to the nearest Sorting Office. You should receive a card notifying you of what action has been taken. Redelivery or collection should be free of charge, but we shall not be liable for any charges that are levied by Royal Mail, Parcelforce or a Courier in this regard, with the exception of additional charges in the unlikely event that not enough postage was paid for delivery. In this case, please contact us as soon as possible so that we can redress our oversight.
Delivery delayed or not received
If delivery is delayed we recommend in the first instance that you contact your local Royal Mail Sorting Office or, if the parcel was sent by Courier, use any tracking details we will have provided. Please bear in mind that whilst Royal Mail First Class delivery normally takes 1-2 days, and the Royal Mail Standard Parcels service normally takes 3-5 days, these are not guaranteed.
In the event that you do not receive your order within 13 working days of it's dispatch and enquiries to locate the parcel/s have been exhausted, we will consider the parcel/s lost and discuss with you whether you would like us to re-send the item/s, subject to their availability, or cancel the order. We will not send replacements or issue a refund until 13 working days have passed.
We are not liable for any inconvenience or loss caused by delayed delivery or failure to deliver caused partly or wholly by circumstances which are beyond our control.
During the checkout process you have the option of providing an alternative delivery address, should you wish us to send your order to a destination other than your billing address. Your billing address must match that of the card or account you use to make payment.
Cancelling your Order
You may cancel your order within 7 working days of placing it (excluding weekends or Bank Holidays) by notifying us by email to email@example.com or by using the form on the Contact Us page of the website. Please note that this does not apply to made-to-measure, made-to-order or personalised items if the order is already being processed. If your order has already been dispatched it will be treated under the Returns Policy below.
We hope you will be happy with your purchase, but have a no quibble approach if for any reason you would like to return an item, so long as:
i) you return the item/s within 14 working days of their receipt (excluding weekends and Bank Holidays and commencing on the day after delivery of the goods), having notified us of the return;
ii) the goods have not been used or damaged in any way;
iii) the goods are returned with the original product packaging and the packaging has not been damaged in a way that would prevent resale.
The cost of return postage is at your own expense, unless the goods are faulty, damaged or not as ordered or described. We strongly recommend you obtain a free Proof of Posting from the Post Office as this would enable you to make a claim should the item be damaged or lost in transit. We cannot be held responsible for items lost or damaged in transit and in these circumstances we reserve the right not to provide a refund.
To initiate a return please submit the details on the Returns page of the website. If you are registered with Ginger & May the easiest way to do this is by viewing your order on your My Account page, clicking on the relevant product and choosing "return product" from the drop-down menu labelled "choose an action".
We will be happy to exchange your item for an alternative one, if the original is returned within the timeframe and condition as specified under the Returns policy above. The alternative will be dispatched at no additional delivery charge once we have received the returned item. The cost of returning the original item will be at your expense. Please email us on firstname.lastname@example.org to discuss the exchange.
Faulty or Damaged Goods
If the product is found to be damaged or faulty on receipt please notify us within 7 working days (excluding weekends and Bank Holidays and commencing on the day after delivery) by email on email@example.com, via the form on the Contact Us page of the website or by telephone on 01929 424572. We will arrange with you for it’s return and refund or replacement (subject to availability). In these circumstances, both the original delivery charge and your postage expense in returning the item will be refunded on receipt of the item at Ginger & May so long as this is within 30 days of you having received the goods.
We strongly recommend you obtain a free Proof of Posting from the Post Office when returning faulty or damaged items as this would enable you to make a claim should the item be further damaged or lost in transit. We reserve the right not to provide a refund if you are unable to prove that the item was sent or in the event that you are able to claim for it's full value in the event of it being damaged or lost in transit.
If an item is not faulty on receipt, but later develops a fault please email details to us on firstname.lastname@example.org as soon as possible. A decision on whether a replacement or refund is appropriate will be made in accordance with the Distance Selling Regulations and will usually depend on the time that has lapsed since you received the goods.
Items not as described
If we are at fault for providing a factually inaccurate description or if the colour, design or quality is clearly not as depicted or described we will normally reimburse the cost of returning the item if this is done in accordance with the provisions for Faulty or Damaged Goods above.
For items returned in accordance with the provisions above, a refund will be credited as soon as possible after receipt by us of the returned item/s, and within 30 days at most. Refunds will be credited by the same payment method as was used to purchase the item/s being returned.
3) REGISTRATION, SUBSCRIPTION AND USER GENERATED CONTENT
You can opt to subscribe to our newsletter, which we email or send by post from time to time. This may take the form of information about products or the Ginger & May brand, or promotional offers. You can subscribe/unsubscribe at any time by changing the setting on your My Account page of the website.
Feedback, Reviews and Other User Generated Content
We welcome feedback, product reviews, testimonials or comments on our blog or in response to our articles, but we reserve the right not to publish any that we consider to be factually inaccurate, written out of malice, containing profanities, or inappropriate for any other reason. Any opinions expressed by users in user-generated content are the opinions of those users and do not represent the views or opinions of Ginger & May as a business or any of it's owners or staff as individuals. Unless required by law, we shall not be liable for any hurt or loss caused by publishing them.
